If your disability case is going to trial, be sure to have your Columbia SC Social Security attorneys by your side to assist you in the process. Having your Social security attorney go over the process with you will help you to better understand what to expect from the hearing and how you should respond during your testimony.

Purpose Of Your Testimony

Before your case reaches the testimony phase, your Columbia SC Social Security attorneys will prepare you for what to expect during the process. By testifying at your own disability hearing, there are two points that you are trying to make:

  • You are unable to do any of the work for the jobs that you previously held over the past 15 years
  • You are unable to perform the duties necessary for any other job that has a large number of entry positions

During your testimony, your Social Security attorney will ask you to speak about the easiest position that you have held during the past 15 years. Then you will be asked to explain why that job is not possible for you to hold now. Before your testimony, your Social Security attorney will go over with you what answers are not relevant during your hearing. Whether a job is considered to be easy or not, you still may not be able to perform the duties due to your disability. Your Social Security attorney will go over that point during your hearing. Your disability may prevent you from even being able to perform the duties of a sedentary position. You may not be able to sit for long hours, use your hands to type, or miss too many work days due to your disability. The judge may find that you are able to perform the duties of a sit-down, sedentary job. However, if you meet the criteria of Social Security’s disabled regulations, then you will be considered disabled. When your case goes into a disability hearing, it will be heard by an Administrative Law Judge (ALJ) for the Social Security Administration. The ALJ wants to hear the facts, not common sense answers or arguments. Using common sense arguments with the ALJ may end up hurting, and not helping your disability case. Your Social Security attorney will instruct you how to answer questions from the ALJ in a manner that will help your case.
