HOW GREENSBORO DISABILITY LAWYERS EXPLAIN SSI AND DISABILITY

If you have applied for disability, or if you are considering applying, Greensboro disability lawyers may be able to help you through the process. Determining whether you are eligible for disability is one way they may be able to help. The Social Security Administration has specific guidelines in place for determining eligibility for disability benefits.

HOW THE SOCIAL SECURITY ADMINISTRATION DEFINES DISABILITY

In order for you to be considered disabled, you must fit the definition of disability found in the Social Security Act. You must have a medically determinable physical or mental impairment that results from anatomical, physiological, or psychological abnormalities. This impairment must be demonstrable by what the Social Security Administration considers medically acceptable clinical diagnostic techniques. The impairment must meet the duration requirement as well. The duration requirement is met if the impairment is expected to result in death, or if the impairment has lasted or can be expected to last for a continuous period of at least 12 months. The impairment must prevent the performance of past relevant work and any other substantial gainful work considering the claimant's age, work experience, and education.

THE SSI PROGRAM AND THE DEFINITION OF DISABILITY

The definition of disability is the same for the SSI program, or the Supplemental Security Income Program. This program provides disabled people with a minimum income level even if they have not worked enough to earn higher Social Security disability benefits. However, SSI benefits are still below what is federally considered the threshold of poverty.
